Terms of Service

1. Agreement & Acceptance

These Terms incorporate our Privacy Policy and Cookie Policy by reference. You accept these Terms by using the Service; no account or signature is required. If you use the Service on behalf of another person, you represent that you are authorised to accept these Terms on their behalf.

2. Definitions

• “Service” — the Kruthika.fun website, chat application, blog and related pages.
• “AI Output” — any text, voice, image suggestion or other material generated by the AI in response to your input.
• “Your Content” — messages and preferences you type or store locally while using the Service.
• “Persona” — the fictional character “Kruthika” simulated by the Service.

3. Nature of the Service — You Are Talking to an AI

Kruthika is a fictional, automated AI persona. All conversation is generated by machine-learning models; no human reads or replies in real time. In accordance with Article 50 of the EU Artificial Intelligence Act and comparable disclosure standards, we clearly and conspicuously inform every user that they are interacting with an AI system — on this page, in the chat interface, and across our marketing.

The Persona is designed for entertainment, companionship and supportive conversation. It has no legal, medical or professional capacity, and nothing it says constitutes professional advice.

You must be at least 18 years of age — or the age of legal majority in your jurisdiction if higher — to use the Service. By using it you warrant that you meet this requirement. We do not knowingly permit minors; if we learn that a minor is using the Service we will terminate access and delete associated data (see our Privacy Policy, §12).

6. Acceptable Use Policy

You agree not to use the Service to:

• generate, request or distribute sexual content involving minors, non-consensual scenarios, illegal material, or violent threats;
• harass, stalk, defame or threaten any real person, or impersonate a real individual or organisation;
• attempt to extract, bypass or reverse-engineer system prompts, safety boundaries, rate limits or internal APIs;
• deploy scrapers, bots, load-testing tools or denial-of-service techniques against our infrastructure;
• probe or scan for vulnerabilities without written permission (responsible reports are welcome at security@kruthika.fun);
• misrepresent AI-generated content as human-authored professional advice;
• violate any applicable local, national or international law or regulation.

7. Your Inputs & Privacy

You are solely responsible for the messages you send. Do not input confidential or sensitive personal data — chats are processed by third-party AI providers purely to generate a reply and are not stored in readable form on our servers. Your local memory stays on your device. How we handle the limited technical data we do collect is described in our Privacy Policy.

8. AI Outputs — No Reliance

AI Outputs are generated probabilistically and may be inaccurate, incomplete, outdated or fictional by design. They reflect the Persona’s creative simulation — not facts about any real person, product or service. Do not rely on AI Output for medical, psychological, legal, financial or other professional decisions. Always verify independently.

To the maximum extent permitted by law, we disclaim all responsibility for decisions you make in reliance on AI Output, and for any similarity between AI Output and real-world persons, living or dead.

9. Intellectual Property

The Kruthika brand, Persona design, artwork, website code, prompts and system architecture are our intellectual property (or licensed to us) and are protected by applicable IP laws. You retain rights in Your Content. We receive a limited, non-exclusive licence to process Your Content solely as needed to operate the Service (e.g. transmitting it to an AI provider to generate a reply). You may use AI Outputs for personal, non-commercial purposes; you may not present them as human-authored, resell them, or use them to train competing models.

10. Availability & Changes

The Service is provided free of charge with generous fair-use limits. We continuously improve it and may add, modify or remove features, adjust quotas, change AI providers, or suspend the Service (in whole or part) at any time for maintenance, security or business reasons. Where practicable we will give advance notice of material changes via the website.

11. Third-Party Services & Advertising

The Service relies on third-party providers (AI inference, hosting, push notifications and consent-gated contextual advertising — see our Privacy Policy, §6). Their availability and terms are outside our control, and their own policies apply to their services. Advertisements are labelled and served contextually; we do not permit advertisers to target you using your chat content. We are not liable for third-party content or practices, but we carefully vet providers for privacy alignment.

12. Suspension & Termination

You may stop using the Service at any time; clearing your browser data erases your local memory instantly. We may suspend or terminate access — immediately where necessary — if you materially breach these Terms, create legal or security risk for us or others, or abuse fair-use limits. On termination, the licence granted to Your Content ends; provisions that by nature should survive (IP, disclaimers, liability limits, governing law) remain in force.

13. Disclaimers & Limitation of Liability

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, whether express, implied or statutory — including merchantability, fitness for a particular purpose, accuracy and non-infringement — except where such warranties cannot be excluded under mandatory law.

To the maximum extent permitted by law, Kruthika and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill arising from your use of (or inability to use) the Service or AI Outputs. Our aggregate liability for all claims shall not exceed the amount you paid us in the twelve months before the claim — which, because the Service is free, is typically zero.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable consumer- protection law (including statutory rights of consumers in the EU/UK, India and elsewhere). Where liability cannot be excluded but can be limited, it is limited to the fullest extent permitted.

14. Indemnification · Governing Law · Changes

Indemnification. You agree to indemnify and hold harmless Kruthika and its operators from claims, damages and expenses arising from your breach of these Terms or misuse of the Service.

Governing law. These Terms are governed by the laws applicable at the Operator’s principal place of business, without prejudice to mandatory consumer-protection rights in your country of residence — including the right to bring proceedings in your local courts where such a right cannot be waived.

Changes. We may update these Terms from time to time. The “Last Updated” date reflects the current version, and material changes will be highlighted on the website with reasonable advance notice. Continued use after changes take effect constitutes acceptance.
